2.4 Market Research

We do not use the data collected as part of market and opinion research for advertising purposes. Detailed information (especially regarding the evaluation of your responses) can be found within the respective survey or wherever you provide your information. Your survey answers will not be shared with or published by third parties. The legal basis for processing your data is your consent.

2.5 Competitions

For prize draws, we use your data to notify winners and to advertise our offers. Detailed information can be found in the terms and conditions for each prize draw.

2.6 Online Shop

2.6.1 General

If you wish to use the services of our online shop, you will need to provide us with the data required to process your order. The mandatory information required for processing your order is marked accordingly. Providing any other information is voluntary.

You have the option of providing your order details only once for this order, or creating a customer account where your data will be saved for future purchases. We store your data for the purpose of fulfilling the contract and delete it as soon as we are no longer legally obligated to retain it.

As part of the order processing, the service providers we use (such as carriers, logistics companies, and payment processors) receive the data necessary for order and payment processing. This data includes, among other things, your email address and telephone number, so that they can, for example, clarify any questions regarding delivery or payment with you. The payment processor you select is responsible for your payment data.

2.6.2 Setting up a customer account

By opening a customer account, you will receive password-protected direct access to your completed, open, and recently shipped orders. You can also view your personal data and manage your newsletter subscription.

To open a customer account, you must provide the following information:

To process your order, we need your correct name, address, and payment information. We need your email address to confirm receipt and shipment of your order, and generally to communicate with you. We also use your email address for identification (as your username) when you log in to your customer account.

If users have terminated their user account, their data relating to the user account will be deleted, subject to legal retention obligations. It is your responsibility to back up your data before the end of the contract after termination. We are entitled to irretrievably delete all data stored during the contract period.

2.6.3 Credit check

To protect ourselves against payment defaults and to offer our customers the best possible payment options in our online shop, we obtain information about your previous payment history and creditworthiness from CRIF AG, Hagenholzstr. 81, 8050 Zurich, during the ordering process. Depending on the result of the credit check, we offer you various payment options. This credit check also serves your and our security by preventing fraud and other criminal offenses.

As part of the credit check, all previous orders in your customer account are reviewed. Additionally, it is checked whether the delivery address differs from the billing address, whether it is a new delivery address, or whether the order is to be delivered to a parcel locker.

You can object to the processing of your data based on our legitimate interest at any time ( info@flowersdecor.ch ), and we will review your request.

We would also like to inform you that payment history, particularly regarding undisputed and overdue receivables, as well as, where applicable, debt collection information and address data, will be transmitted to CRIF AG in Zurich for lawful use as a credit reporting agency. CRIF will use the data to verify your identity and creditworthiness and will disclose it to authorized third parties. CRIF may analyze the payment history using mathematical-statistical methods for automated decision-making, particularly for assessing an individual's creditworthiness. 2.6.4 Product evaluation and satisfaction survey

You will have the opportunity to rate products and leave comments. For this, we need your name or a pseudonym, which will be displayed along with your country of origin.

Seven days after placing your order, you will receive an email with the opportunity to rate the product you ordered. For this, we use the technology of Bazaarvoice Ltd. (10901 Stonelake Blvd, Austin, TX 78759), which stores cookies on your computer (more information about cookies and how to disable them can be found below). Bazaarvoice is certified under the Privacy Shield. Additionally, you will have the opportunity to participate in a customer satisfaction survey (offered by SurveyMonkey Europe UC, Shelbourne Buildings 2, Shelbourne Road, Dublin, Ireland). This survey is anonymous.

We use these technologies to improve the customer experience and to be able to respond to customer needs, which is a legitimate interest.

2.7 Online applications

When you apply for a position with us, your personal data will be processed for the purpose of handling your application. This processing may also take place electronically (e.g., via email). If we conclude an employment contract with an applicant, the transmitted data will be stored for the purpose of managing the employment relationship in accordance with legal regulations.

If the application process ends without an employment contract, your data will be deleted unless you have given us your consent to use your information for future applications with us. 2.8 Use of email communication

To improve electronic communication, which is in our legitimate interest, we may analyze user behavior with regard to emails sent by the company. We log the links contained in these emails that are clicked directly. This information is assigned to specific user profiles. This allows us to identify the areas that are most interesting to registered email recipients. We use this information to personalize content and advertising campaigns displayed to website visitors and email recipients.

2.9 Use of Olapic

We use the services of Olapic Inc. (250 Vesey Street, 4th Floor, New York, NY 10281, USA) to share photos of our products as inspiration for others. Olapic searches for suitable images on Instagram or Twitter on our behalf, which are then displayed on our website and linked to the respective Instagram or Twitter account holder. This allows us to showcase our products and how they are presented on social media, which is in our legitimate interest. 3. Deletion

We process and store your personal data only for the period necessary to achieve the purpose of storage or as required by laws or regulations to which we are subject. If the purpose of storage ceases to apply or a prescribed retention period expires, the personal data is routinely blocked or deleted in accordance with legal requirements.

In addition, we will delete your data if you request it from us at  info@flowersdecor.ch  and we have no legal or other obligation to retain or back up this data.

4. Disclosure to third parties

We only share your data if you have expressly consented to this, if we are legally obligated to do so, or if this is necessary for the use of the website, answering questions, processing inquiries, or providing any services you have requested. We also use tracking pixels in our newsletters. For each newsletter sent, information is provided about the mailing list used, the subject line, and the number of newsletters sent. Furthermore, it is possible to see which addresses have not yet received the newsletter, which addresses it was sent to, and which addresses experienced delivery failures. The open rate is also recorded, including information about which addresses actually opened the newsletter. Finally, information about which addresses have unsubscribed is also provided. We use this data for statistical purposes and to optimize the newsletter in terms of content and structure. This allows us to better tailor the information and offers in our newsletter to the individual interests of the recipients. The tracking pixel is deleted when you delete the newsletter. To prevent the use of the tracking pixel in our newsletter, please configure your email program, if it is not already set to do so by default, to display messages in plain text only.

9.2 Google Analytics

Based on our legitimate interests (i.e., our interest in analyzing, optimizing, and operating our online services economically), we use Google Analytics, a web analytics service provided by Google Inc. ("Google", 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google uses cookies.

The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored on a Google server in the USA. Google is certified under the Privacy Shield agreement and thus guarantees compliance with European data protection law.

Google will use this information on our behalf to evaluate users' use of our online services, to compile reports on activity within these online services, and to provide us with other services related to the use of these online services and internet usage. Pseudonymous user profiles may be created from the processed data. These user profiles will be automatically deleted after 26 months.

We only use Google Analytics with IP anonymization enabled. This means that Google shortens the IP address of users within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user's browser is not merged with other Google data. Users can prevent the storage of cookies by adjusting their browser settings; furthermore, users can prevent Google from collecting and processing data generated by the cookie and related to their use of the online service by downloading and installing the browser plugin available at the following link:  http://tools.google.com/dlpage/gaoptout?hl=de .

9.3 Google AdWords

Based on legitimate interest, we use the advertising program "Google AdWords," which belongs to Google Marketing Services Online. Google AdWords places a cookie on your computer ("conversion cookie") if you have reached our website via a Google ad. These cookies expire after 30 days and are not used for personal identification. If you visit certain pages on our website and the cookie has not yet expired, we and Google can recognize that someone clicked on the ad and was thus redirected to our site. Each AdWords customer receives a different cookie. Therefore, cookies cannot be tracked across the websites of different AdWords customers. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. We do not receive any information that can be used to personally identify you.

9.4 Google DoubleClick

This cookie assigns your browser a pseudonymous identification number and collects information about the advertisements displayed in your browser and whether you click on them.

The information collected by the cookie about your use of websites is generally transmitted to and stored on a Google server in the USA. Based on this information, your browser is assigned interest-based categories. These categories are used to display interest-based advertising.

In addition to changing your browser settings, you can also permanently disable the DoubleClick cookie using a browser plug-in. 9.5 Google Tag Manager

Google Tag Manager is a solution that allows marketers to manage website tags through a single interface. We use Google Tag Manager to integrate and manage Google's analytics and marketing services on our website. The Tag Manager tool itself, which implements the tags, is a cookieless domain and does not collect any personally identifiable information. However, the tool triggers other tags, which may in turn collect data. Google Tag Manager itself does not access this data.

9.6 Affilinet

Affilinet is a service provided by Affilinet GmbH, Sapporobogen 6, 80637 Munich, Germany. Affiliate systems are based on the principle of referral commissions. Referrals are made in the virtual world of the World Wide Web via a link. Such an affiliate link contains a special code that uniquely identifies the affiliate to the merchant. In simpler terms: the link with the affiliate identifier allows the merchant to see who referred the customer. The commission is paid for clicks on the advertising material ("click"), the transmission of qualified customer leads ("lead"), or the sale itself ("sale"). Unlike the merchant (literally: trader; here also program provider or operator), who offers goods or services, the affiliate merely acts as an intermediary between merchants and potential customers.

When someone clicks on such an affiliate link, they are redirected to the corresponding merchant's website. Parameters are transmitted during this process, allowing the publisher to precisely attribute the generated revenue. This method is called tracking. Cookie tracking, for example, enables the identification and tracking of a visitor using a cookie. The cookies stored on the visitor's hard drive allow for subsequent recognition and tracking (even with delayed or interrupted interaction). Tracking using cookies is the most widely used method in affiliate marketing for attributing a person to the corresponding affiliate.

9.7 Getback, Profity and Friendify

Getback, Profity, and Friendify are technologies from adfocus GmbH, based in Zug, Switzerland. We integrate these technologies into our website, which may involve the exchange of data such as IP addresses and shopping cart contents with adfocus. Adfocus is only permitted to process our customers' data on our behalf in the same way that we ourselves would be allowed to.

Getback is used to improve targeted communication with our existing and future customers. With this technology, we can, for example, remind our customers of forgotten orders when they visit our online shop, inform them about special offers, or allow them to have their shopping cart sent to them by email for later use.

Profity is used so that customers receive a voucher after placing an order, which can be used in another shop within the Profity network. Likewise, customers can redeem Profity vouchers they have received from other shops within the Profity network at Flowersdecor.

Friendify is used so that the website can be recommended to third parties.

We use these technologies based on legitimate interest so that we can offer our website permanently, securely and reliably, and advertise our services.

9.8 months

Monetate is a service provided by Monetate Inc. (East Hector Street, Conshohocken, Pennsylvania 19428, USA). Monetate uses cookies, which are stored on your computer. This enables us to analyze and optimize the use of our website, which is in our legitimate interest. The information generated by the cookies about your use of this website is stored and processed on our behalf on cloud-based servers (operated by Amazon Web Services, Inc.) in the USA and the European Union. Monetate Inc. is certified under both the Swiss-US and EU-US Privacy Shield Frameworks. Before further processing, your IP address is anonymized and replaced with a shortened, non-identifiable IP address. This prevents any direct personal identification. 9.9 Hotjar

Hotjar is an analytics service provided by Hotjar Ltd. (St Julians Business Centre, Elia Zammit Street, St Julians STJ 1000, Malta). We use Hotjar to better understand our users' needs and to optimize the content on this website. Hotjar's technology gives us a better understanding of our users' experiences (e.g., how much time users spend on which pages, which links they click, what they like and dislike, etc.), which helps us tailor our offerings to user feedback, a legitimate interest of ours. Hotjar uses cookies and other technologies to collect information about our users' behavior and their devices (in particular, the device's IP address (collected and stored only in anonymized form), screen size, device type (unique device identifiers), information about the browser used, location (country only), and preferred language for viewing our website). Adform is a service provided by Adform A/S (Wildersgade 10B, 1408 Copenhagen, Denmark). This service is used for tracking and controlling digital advertising campaigns, which is in our legitimate interest.

Adform uses cookies that are stored on your computer, but these do not contain any personally identifiable information such as your name, email address, or other personal details. The cookies contain technical information such as the frequency and date of ad impressions, the browser used, and the operating system. It is not possible to identify you personally from this data. Adform does not store full IP addresses; instead, it truncates the last octet.

9.11 Outbrain

This website uses technology from Outbrain Inc. ("Outbrain", 39 W 13th Street, New York, NY 10011 USA). The technology relies on a cookie-based analysis of user behavior. This advertising appears only on Outbrain advertising platforms, either on Outbrain Engage or the Outbrain Extended Network. 9.12 Plista

Our website uses technology from plista GmbH, Torstraße 33, 10119 Berlin. With the help of this technology, we aim to improve the quality and relevance of our advertisements by tracking whether and which of our ads are successful for end customers (so-called conversion tracking) and which ads are clicked by end customers (so-called click tracking). After a user clicks on one of our ads, plista places a temporary cookie in the user's browser, which assigns a tracking point as soon as the user reaches the target page. 10. Social Plugins / Social Media Functionalities

10.1 What Social Plugins are

Plugins are small programs or program packages that allow users to customize and extend software to suit their individual needs. Many programs, such as graphics programs, media players, or web browsers, support the basic functions required by the average user in their initial version. Increasingly, however, these programs are becoming more flexible, offering extensive possibilities for extension through plugins or add-ons.

10.2 Which plugins we use

On our website we have included links to our social media profiles on the following social networks:

When you click on a link to one of our social media profiles, a direct connection is established between your browser and the server of the respective social network. This allows the network to receive information that you have visited our website and clicked on the link using your IP address. If you click on a link to a network while logged into your account on that network, the content of our page can be linked to your profile on the network. This means that the network can directly associate your visit to our website with your user account, and we receive personal data such as your name, email address, location, friends list, and profile picture. This data allows us to offer certain features on our pages. If you wish to prevent this, you should log out before clicking on any such links. Association will occur regardless if you log in to the respective network after clicking on the link.

If you are logged into your Facebook, Google, or Instagram account while visiting our website, the respective provider can also associate your visit with your user account. If you interact with a plugin, for example by clicking the "Like" or "+1" button, the corresponding information is also transmitted directly to a server of the respective provider in the USA and stored there. This information is also published via your user account on the respective social network and displayed to your contacts there.

Even if you are not logged in to the providers of the plug-ins while visiting our website, the data collected by the plug-ins may still be associated with your respective user account. Each time a plug-in is accessed, a cookie with an identifier is set. Since your browser automatically sends this cookie with every connection to a server of the respective provider, Facebook, Google, and Instagram could, in principle, create a profile of which websites the user associated with that identifier has visited. It would then potentially be possible to later link this identifier back to a specific individual – for example, when logging in to the provider's service later.

If you do not want the plug-in provider to associate your visit to our website with your profile, you must log out of the respective service before visiting our website. Alternatively, you can select the "Block third-party cookies" option in your browser settings. This will prevent your browser from sending cookies to the respective social network's server. However, with this setting, in addition to the plug-ins, other cross-site functions from other providers may also no longer work.

11 Facebook Connect

We offer the "Facebook Connect" function, provided by Facebook Inc., as an optional feature for creating your customer account and logging into our website and applications.

If you wish to use this feature, you will first be redirected to Facebook. There, you will be asked to log in with your username and password. We, of course, do not have access to your login details. If you are already logged in to Facebook, this step will be skipped.

Facebook will then inform you which data will be transmitted to us (public profile, friends list, email address, and current location). You confirm this by clicking the "OK" button. We will create your customer account using the transmitted data; your friends list will, of course, not be stored by us. For logging in via Facebook Login, a unique token (a long string of letters and numbers) generated by Facebook will also be stored. This token is exchanged with Facebook during the login process for secure authentication.

12. Your Rights

You have the fundamental rights to information, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent with regard to your data. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed, you can lodge a complaint with the supervisory authority.

Please note that by law, certain data must be retained for a specific period. Such data must therefore remain stored with us until these periods expire. We block this data in our system and use it only to comply with legal requirements.


13. Use of the website by minors

This website is intended for an adult audience. Minors, especially children under 16, are prohibited from submitting their personal data to us or registering for any of our services. If we discover that such data has been submitted to us, it will be deleted from our database. The child's parents (or legal guardian) can contact us to request deletion or unsubscription. For this, we require a copy of an official document proving you are the parent or legal guardian.

This privacy policy may be supplemented or amended by Flowersdecor at any time. All changes and additions are at the sole discretion of Flowersdecor.
